1. Acceptance of Terms
By downloading, accessing, or using Lumina Diary (the “App”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.
2. App Usage and Data Loss
The App uses anonymous authentication to protect your privacy. Because there is no traditional user account tied to an email or phone number, we cannot recover your data if you lose your device, uninstall the App, or clear the App’s data. It is your responsibility to manage your device and data backups.
3. Premium Subscriptions
The App offers premium features, including AI-driven image generation, accessible via an auto-renewing subscription.
- Billing: Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
- Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Cancellation: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play after purchase. We cannot cancel subscriptions on your behalf.
4. AI-Generated Content (Gemini API)
Premium users have access to image generation based on their mood tracking, powered by the Gemini API.
- Unpredictability: AI-generated content is highly unpredictable. We do not guarantee the accuracy, appropriateness, or specific visual outcome of the generated images.
- Acceptable Use: You agree not to manipulate the app’s inputs in an attempt to generate illegal, harmful, offensive, or explicit content.
- Ownership: Subject to Google’s Gemini API terms and applicable copyright laws, the images generated during your session are provided for your personal, non-commercial use.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Lumina Diary and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use or inability to use the App; (b) the loss of your anonymous data; or (c) the performance of third-party APIs like the Gemini API.
6. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Continued use of the App after any such changes constitutes your consent to such changes.
